Terms of Use

Scope of service.

These terms and conditions apply to all our services that are directly or indirectly provided (i.e., via third parties) via the mobile application, internet, website, newsletter, by email or by telephone (collectively ‘Services’).

By using our sites, you confirm that you have read, understood and agree to these Terms of Use, as well as the Privacy Policy.

ATM Fee Saver is a mobile application available on Apple Store for iOS users and Google Play Store for Android users (‘Mobile App Store Providers’)

Your usage of the service.

You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Services on any Devices that you as the end-user own or control and as permitted by the respective Mobile App Store Providers.

These Terms of Use will also govern any updates of the Services provided by ATM Fee Saver that replace, repair, and/or supplement the first Services, unless a separate license is provided for such update, in which case the terms of that new license will govern.

You cannot not share or make the Services available to third parties unless with ATM Fee Saver’s prior written consent), sell, rent, lend, lease or otherwise redistribute the Services.

You cannot not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Services, or any part thereof (except with ATM Fee Saver’s prior written consent).

You cannot not copy (excluding when expressly authorised by these Terms of Use) or alter the Services or portions thereof. You cannot create and store copies of any of the information provided by our Services even on devices that you own or control for backup keeping under the terms of these Terms of Use and any other terms and conditions that apply to the device or software used.

You may not remove any intellectual property notices. You acknowledge that no unauthorised third parties may gain access to these copies at any time. If you sell your devices to a third party, you must remove the Services from the devices before doing so.

Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.

ATM Fee Saver reserves the right to modify the terms and conditions of licensing.

Nothing in these Terms of Use should be interpreted to restrict third-party terms. When using the Services, you must ensure that you comply with applicable third-party terms and conditions.

You are not granted rights to claim any updates of ATM Fee Saver.

You acknowledge that it is your responsibility to confirm and determine that the end-user device on which you intend to use the Services satisfies the technical specifications as mentioned.

ATM Fee Saver reserves the right to modify the technical specifications as it sees appropriate at any time.

You acknowledge that the Services is not obligated, expressed or implied, whatsoever, to provide any maintenance, technical or other support services with respect to the Services.

You acknowledge that the intellectual property of the Services remains solely with ATM Fee Saver or the respective third-parties whose services are integrated within the Services and at no point, you will claim or infringe upon such intellectual property rights.

You acknowledge that ATM Fee Saver will be able to access and adjust the Services content and your personal information, and that ATM Fee Saver’s use of such material and information is subject to ATM Fee Saver’s Privacy Policy.

You acknowledge that ATM Fee Saver may periodically collect and use technical data and related information about your device, system, and application software, and peripherals, offer product support, facilitate the software updates, and for purposes of providing other services to you (if any) related to the Services. ATM Fee Saver may also use this information to improve its products or to provide services or technologies to you.

Users access and use the information provided by our Services at their own risk. We do not guarantee the effect of use of the information provided by our Services on any of the sites, on the user. In particular, there is no advice or information from ATM Fee Saver regarding recommendation of selection of ATM service providers by the user.

The user is responsible for the acquisition of rights to the content (text, photos, reviews, links, etc.) they upload to ATM Fee Saver. They ensure that they have all the rights in respect to the content they publish on the ATM fee saver platform and thereby do not violate the rights of any third parties. The user guarantees not to use the ATM Fee Saver services to create content that:

is advertising disguised as reviews
does not have specific content for a reviewed item
is not objective or intentionally untrue
immoral, pornographic or in any other way offensive
infringes upon the rights of third parties, in particular copyright

violates applicable laws in any way or constitutes a criminal offense
contains viruses or other computer programmes that may damage software or hardware or that may affect the use of computers
is a survey or chain letter
is aimed at collecting or using personal data from other users, especially for commercial purposes

The user guarantees not to use programmes or functions to generate automated page impressions or content of / from ATM Fee Saver.

If there is a breach in the Terms of Use, ATM Fee Saver reserves the right to remove content without declaration of reason, to withhold payments and to permanently ban members from ATM Fee Saver. The right to prosecution of criminal acts remains unaffected.

The user is responsible for the accuracy and completeness of their personal information.

The user is responsible for the confidentiality of their user account information, in particular their password. They are also responsible for the use of their account with regard to ATM Fee Saver and third parties. The user should not divulge this data to the use by third parties.

In the event of unauthorised use of the ATM Fee Saver services using the wrong username and password, the registered user must notify ATM Fee Saver immediately. We do not guarantee to be able to provide remediation in such misuse except deletion of the account upon due verification, in which case you will need to sign-up again if you wish to use the Services again.

Our services.

The mobile application of ATM Fee Saver may provide information on some ATMs near your location as per your provided location access on your mobile device or limited information on some of the ATMs in countries provided in our database. The app may also provide information on transaction limits or withdrawal limits for some of the said ATMs and estimated percentage calculations. We provide information, where possible, as collected from ATM service providers or information that is crowdsourced. We also provide information as collected or provided from third-party integrations. Calculator functionality on the mobile application may assist in calculating approximate ATM usage fees for some said ATMs, based on your voluntary disclosure of your intended withdrawal amount. At any point, the app may or may not choose to provide generic guides on using ATM withdrawal services in some of the said list of countries. For the purpose of clarity, when you use our Services, ATM usage fee means the fee that is possibly charged by an ATM service provider to specifically use the cash withdrawal service of its ATM and, such fee is specifically charged to foreign users i.e., the issuing country of the users’ cards and country of the ATM location are different and, when such foreign users use a debit card to withdraw cash at the said kind of ATMs and not with any other kind of withdrawal mechanism. ATM usage fees can be known as, but not limited to, ATM cash withdrawal fees or ATM transaction fees, ATM operator fee, ATM access fees, etc. (collectively ‘ATM usage fees’).

Our Services do not provide information on all-inclusive list of ATMs in the location near or close to you, nor all the ATM usage fees or transaction / withdrawal limits related information on any and all ATM service providers in any and all countries. We do not provide information on different types of ATM services or fees in any and all locations. We do not provide information on any and all fees that may be applicable for different types of cards or payment / withdrawal mechanisms. We do not provide information on any other types of fees/charges or other similar terminologies that can construe or mean any applicable mandatory or optional currency conversion charges, any other form of ATM related transaction fees except ATM usage fees, nor any fees or limits as set by the issuing banks of the users’ cards, nor any fees or limits on any types of cards/accounts other than on debit cards as set by the users’ banks or by ATM service providers. We do not provide information on any other services provided by the ATMs including but not limited to, withdrawals by credit cards, QR codes, other regionally implemented mechanisms, cash advances, deposits, transfers, etc. We do not provide information on specific card tie-ups between users’ card issuing financial institutions and ATM service providers nor any specific fee or other related information not specifically mentioned herein. We do not verify or provide information on addresses or locations of any and all ATMs in any and all countries. We do not provide information on various terminologies used by ATM service providers in different countries, their meanings and translations. Please note, this is not an all-inclusive list. As such any of our services should not be construed as giving any form of financial advice or recommendation at any point.

The Services may invite you to chat, contribute to, or participate in providing feedback, blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or in the Services, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, ‘Contributions’). As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party
You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorise us, the Services, and other users of the Services to use your Contributions in any manner contemplated by the Services and these Terms of Use
You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness or each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Services and these Terms of Use
Your Contributions are not false, inaccurate, or misleading
Your Contributions are not unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation
Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us)
Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone
Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people
Your Contributions do not violate any applicable law, regulation or rule
Your Contributions do not violate the privacy or publicity rights of any third party
Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors
Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap
Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation

Any use of the Services in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Services.

When you share Your Contributions with us, we have the right and sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions, (2) to recategorise any Contributions to place them in more appropriate locations in the Services, and (3) to prescreen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions or inform you on if, how and when your Contributions are used as part of our Services.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Services.

Liability.

In no event will ATM Fee Saver, its employees, officers, directors, agents, successors, representatives, affiliates, group companies, subsidiaries or assigns be liable under any circumstances or in any manner for special, direct, indirect, punitive, incidental, exemplary, foreseeable, unforeseeable or consequential or other damages, costs or losses whatsoever that may be caused to the user in any way by the use of the Services.

We do not guarantee the accuracy, updatedness or reliability of the information provided via our Services. ATM Fee Saver has no influence on the nature, veracity and authenticity of any of the collected information. The publication of any information on our Services including user-generated content and reports does not reflect the opinion of ATM Fee Saver, in particular, ATM Fee Saver does not necessarily claim this content as its own.

Users must access and use the information at their own risk. We do not provide any guarantee of the effect of use of the information provided by our Services, on the user. In particular, ATM Fee Saver does not engage in recommendation of any use or selection of ATM service providers as provided on our Services for users’ use.

All agreements and transactions that arise prior or subsequent to the use of our Services, by the users, is between the users and respective ATM service providers or users’ financial institutions. In particular, ATM Fee Saver does not act as facilitator, organiser or any middle agency at any time. The terms and conditions of the respective ATM service provider or users’ financial institutions apply exclusively, especially regarding the right to use, cancel or to withdraw. ATM Fee Saver remains uninvolved in any use by the users of any ATM services, agreements and claims between the users, respective ATM or users’ financial institutions.

We do not provide nor accept any guarantee that your chosen card will work at any of the ATMs as provided part of the information in our Services.

ATM Fee Saver does not guarantee the accuracy of information of the actual presence, location, addresses and / or availability of any ATM listed on our Services.

For technical reasons, no updating of the information we collect or receive or provide in our Services is done in real time. Therefore, it is possible that the information that appears on our Services does not correspond to the timeliness of the information specified by users’ financial institutions, ATMs, websites or other documents of any ATM service providers, where they show any related information and at the time of use by the users.

ATM Fee Saver is not liable for technical malfunctions of ATM service providers or users’ financial institutions.

ATM Fee Saver does not guarantee uninterrupted availability of data and may perform technical maintenance during a freely chosen time period.

We are not liable for any statements or representations in your Contributions provided by you in any area in the Services. You are solely responsible for your Contributions to the Services and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

Hyperlinks, advertising banners, and the like are provided by respective third-party advertisers and do not represent recommendations or information from ATM Fee Saver (unless expressly mentioned in any part of our Services).

ATM Fee Saver takes no accountability or responsibility for any damages caused due to a breach of duties according to Scope mentioned in these Terms of Use. To avoid data loss, you are required to make use of the Services to the extent allowed by these applicable Terms of Use. You are aware that in case users’ non-compliance of any of the Terms of Use, there any can be legal implications, and among other things, your access to the Services can be revoked.

Warranty.

No warranty is provided for the Services and especially for those instances where the Services have been unauthorisedly modified, handled inappropriately or culpably, combined or installed with inappropriate hardware or software, used with inappropriate accessories or outside the scope of the Terms of Use, regardless if by yourself or by third parties, or if there are any other reasons outside of ATM Fee Saver’s sphere of influence that affect the executability of the Services.

ATM Fee Saver does not have warranty obligation whatsoever with respect to the licensed application, and any other losses, claims, damages, liabilities, expenses, and costs attributable to any negligence to adhere to any warranty.

ATM Fee Saver does not warrant that the Services are free of spyware, trojan horses, viruses, or any other malware at the time of your download.

You are required to inspect the Services immediately after installing it and notify ATM Fee Saver about issues discovered without delay by using the “Talk to Us” or feedback related sections of the Services. The defect report will be taken into consideration and further investigated if it has been emailed within a period of days after discovery. ATM Fee Saver reserves a choice to remedy the situation or choose to take no action.

To the maximum extent permitted by applicable law, the Mobile App Store Providers will have no other warranty obligation whatsoever with respect to the licensed application, and any other losses, claims, damages, liabilities, expenses, and costs attributable to any negligence to adhere to any warranty.

By downloading, subscribing to, accessing information of / from or using the Services in any way, you represent and warrant that you are at least eighteen (18) years of age and and of sound mind and are competent to enter into and form a binding contract and are not a person barred from receiving services under the laws of India or other applicable jurisdiction.

Termination.

The license is valid until terminated by ATM Fee Saver or by you. Your rights under these Terms of Use will terminate automatically and without notice from ATM Fee Saver if you fail to adhere to any term(s) of these Terms of Use or choose to uninstall the mobile application. Upon license termination, you shall stop all use of the Services, and destroy and and all copies, full or partial, of the Services.

ATM Fee Saver reserves the right to terminate a user’s access and to delete their registration within a period of two weeks after receipt of relevant information about improper use of our Services. The user may also terminate their own access and registration within the same period. The right to immediate termination for good cause remains unaffected.

Privacy, Email Advertisements.

ATM Fee Saver collects, processes and uses your personal data if you have agreed to our Terms of Use and Privacy Policy during sign-up. Refer to the Privacy Policy for further details.

Third-party terms of agreements and beneficiary.

In Accordance with Section 9 of the ‘Instructions for Minimum Terms of Developer’s End-User Licence Agreement’, both Apple and Google and their subsidiaries shall be third-party beneficiaries of this Terms of Use – upon your acceptance of the terms and conditions of these Terms of Use, both Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof.

Changes to the Terms of Use.

We may update these terms from time to time. The last updated date is available at the top of the policy document. It is the users’ responsibility to regularly check the terms and conditions for any updates.

Applicable Law and Place of Jurisdiction.

The Terms of Use and Services shall be construed, interpreted and enforced in accordance with the laws of India. Any and all disputes, claims or litigation arising from or related in any way to the Terms of Use or Services shall be brought exclusively before the Courts of, or the office of the concerned regulator (if any) in, Mumbai, India.

Miscellaneous

If any of the terms of this agreement should be or become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated in a way that will achieve the primary purpose.

Collateral agreements, changes and amendments are only valid if laid down in writing. The preceding clause can only be waived in writing.

The English translation takes precedence.
